The Role of Nikah Khwān and Witnesses in Online Nikah

In Islam, the role of the Nikah Khwān (the officiant or Qazi) is to ensure that the marriage adheres to the prescribed conditions of Sharia. In an online Nikah, this responsibility becomes even more critical because the officiant must verify identities, confirm consent, and maintain proper documentation while the participants are connected virtually. The Nikah Khwān then seeks explicit verbal consent from both the bride and groom, asking each to say “Qubool hai” (I accept) three times to formalize the contract. The presence of two Muslim adult witnesses is equally essential; they must be present on the video call to observe the exchange of consent and testify to its authenticity. Witnesses ensure transparency and prevent future disputes regarding the validity of the marriage.

In addition, the Nikah Khwān must ensure that the Mahr (dower) is specified, agreed upon, and recorded in the Nikah Nama. If any special conditions—such as the right to divorce (Talaq-e-Tafweez) or financial clauses—are agreed upon, these are also documented.
